J. ANTHONY CALDWELL

A senior litigator, Tony carries on a broad ranging, general corporate litigation practice with an emphasis on complex, multi -party litigation and arbitration. He has particular experience in Directors and Officers liability, injunctions, litigating and arbitrating contract and shareholder issues, and real estate disputes. He has acted for Crown agencies, corporations and individuals in complex environmental litigation, and has acted for individuals and corporations in municipal and provincial expropriation proceedings. He has appeared in all levels of courts in Ontario, and in the Federal Court and the Supreme Court of Canada. He has also represented individuals and corporations before many provincial regulatory and licensing bodies including the Law Society of Upper Canada, the MFDA and the College of Physicians and Surgeons of Ontario.

PARTICULAR RECENT PROFESSIONAL EXPERIENCE
– Acted as counsel to a landowner whose property had been expropriated by the City of Toronto. Following a six week Ontario Municipal Board hearing, the City was ordered to pay the land owner in excess of $2.4M over what it had offered to pay.
– Acted as counsel to the directors of a multi national manufacturing company in a $15 Million oppression and breach of fiduciary duty action;
– Acted as counsel to the former President and CEO, and CFO of a major Canadian retail corporation in a $100 Million oppression and breach of fiduciary action;
– Acted as counsel to the CEO and other directors of a major Canadian publisher in multi jurisdictional shareholder class actions and other proceedings;
– Acted as counsel to the Directors of a major Canadian Mutual Fund Company in a $1 Billion Shareholder action;
– Acted as counsel to a Crown Agency in a $30 Million contract and environmental Action; and
– Acted as counsel to a Canadian financial institution in a $5 Million negligence and breach of duty action
